GLMA Statement on Supreme Court Decision Upholding the ACA

On June 25, 2015, the US Supreme Court issued a 6-3 decision in King v. Burwell upholding the Affordable Care Act. GLMA Executive Director Hector Vargas issued the following statement:

“GLMA applauds today’s US Supreme Court decision upholding the Affordable Care Act for a second time and ensuring that LGBT individuals and people living with HIV can continue to access critically needed health insurance through Obamacare. While much of the decision focused on rules of statutory interpretation, Chief Justice John Roberts writing for the Court in a 6-3 opinion concluded: 'Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them. If at all possible, we must interpret the Act in a way that is consistent with the former, and avoids the latter.'

"GLMA hopes this decision puts to rest any further challenges to the ACA. Regardless, GLMA will continue its efforts working in coalition with other LGBT organizations and through a strong partnership with the US Department of Health & Human Services to ensure the ACA addresses the healthcare needs and concerns of LGBT people and those living with HIV, including through the ACA’s non-discrimination provisions, data collection initiatives and ensuring fully inclusive healthcare coverage is provided by health insurance plans offered through the exchanges."

GLMA joined a friend-of-the court brief co-authored by Lambda Legal in the case supporting the ACA. The brief focused on the “devastating impact that withdrawal of ACA subsidies would have on people of color living with HIV and on their communities.”
