US Appeals Court Ruling Threatens the ACA

On December 18, 2019, the US Fifth Circuit Court of Appeals upheld a lower court ruling invalidating the individual mandate in the Affordable Care Act but asked the lower court to reevaluate whether the other numerous provisions and nondiscrimination protections of the ACA can stand in absence of the individual mandate.  GLMA President Scott Nass, MD, MPA, issued the following statement in response to the decision:
 
“GLMA is extremely disappointed with the appellate court ruling that invalidates the individual mandate of the Affordable Care Act and threatens healthcare for millions of Americans. The ACA provides critical healthcare access and coverage for 20 million Americans, including an estimated 1.5 million LGBTQ peope, and GLMA will continue to fight to preserve this vital legislation.
